Terms of Service

These Terms are an agreement between you and Frame Perfect LLC, a Texas limited liability company, governing your use of the FramePerfect iPhone app and the web service at app.frameperfect.co (together, the "Service"). By creating an account or using the Service, you accept these Terms.

1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a business, you represent that you have authority to bind it, and "you" includes that business.
You are responsible for your account credentials and for everything that happens under your account. Notify us promptly at support@frameperfect.co if you believe your account has been compromised.
2. What the Service does
The Service captures bracketed exposures on your iPhone, uploads them, merges and finishes them into single photographs, and makes the finished set available to you for review, download, and delivery.
The Service applies exposure fusion and tonal finishing to the frames you captured. It does not generate imagery. Beyond the processing described here, the Service does not add, remove, or invent content in your photographs.
3. Plans, billing, and cancellation
Plans are measured in houses — a single property shoot — not in individual photographs.

On the Basic plan, houses beyond your included allowance are billed as they are used and are capped at $24.99 per additional house — you will never pay more than $24.99 for an extra listing.
Subscriptions renew automatically each month until cancelled, and are billed in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then. Fees already paid are not refundable except where required by law.
Unused monthly houses do not carry over. We may change pricing on 30 days' notice to account holders; changes apply at your next renewal.
Included monthly allowances are subject to a reasonable internal fair-use limit intended solely to prevent abuse of flat-rate plans. It does not apply to pay-as-you-go listings or to per-house overages, and no ordinary professional use approaches it.
4. Your content and ownership
You retain all ownership and copyright in the photographs you capture. These Terms transfer nothing.
You grant Frame Perfect a non-exclusive, worldwide, royalty-free licence to host, store, transmit, process, reproduce, and display your photographs solely to operate the Service and deliver your work to you and to recipients you designate. This licence ends when the content is deleted, except for the separate marketing permission in Section 6.
You represent that you have the rights necessary to photograph each property and to upload, process, and distribute the resulting images, including any permission required from the property owner, occupant, or listing agent.
5. Your responsibilities
The person or business using the Service — whether a professional photographer, an agent photographing their own listing, or anyone else — is the User, and is responsible for the content they capture and for what happens to it after they share it.
- You are responsible for having permission to be at and to photograph a property.
- You are responsible for the accuracy of any address or description you enter.
- Once you deliver photographs to a client or any third party, their use of those photographs is outside our control and is your responsibility, not ours. This includes publication to a listing service, a website, social media, or print.
- You are responsible for downloading your finished photographs before the retention window closes.
6. Marketing use
You grant Frame Perfect permission to use a limited selection of finished photographs produced through the Service in Frame Perfect marketing materials, including our website, app store listing, and promotional materials. We will not identify a property address, an occupant, or a listing client in that use.
You may withdraw this permission at any time by emailing support@frameperfect.co. We will stop using your photographs in new materials, and will remove them from existing materials within a reasonable period.
7. Retention and deletion
The Service enforces automatic retention windows. These are a feature of how the Service is designed and priced, not an error.
- Source bracketed frames are deleted approximately three days after your finished photos are delivered.
- Finished photos and the completed house are deleted thirty days after delivery.
- Share links stop working fourteen days after they are created.
Deletion is permanent and irreversible. We cannot recover deleted photographs, and we have no obligation to retain any content beyond these windows. Downloading your finished work in time is your responsibility.
8. Delivery and share links
You control when photographs are delivered. Nothing reaches your client until you send a share link. A share link grants anyone holding it access to view and download the photographs behind it until it expires, without an account or password.
You are responsible for who you send a share link to and for anything that follows from a link being forwarded or exposed.
9. Acceptable use
You agree not to:
- Use the Service unlawfully, or to capture or distribute content you have no right to.
- Upload content that infringes another person's rights, or that is unlawful, defamatory, or invasive of privacy.
- Attempt to access another account, circumvent entitlement or usage limits, or share one account across multiple people to avoid subscription fees.
- Reverse engineer, decompile, scrape, or attempt to derive the source or models behind the Service.
- Interfere with, overload, or disrupt the Service or its infrastructure.
- Resell or white-label the Service without our written agreement.
We may suspend or terminate accounts that violate this section.
10. Third-party platforms
The Service can deliver finished photographs to a connected third-party platform where your client subscribes to it. Once delivered, that platform holds its own copy under its own terms and retention rules, and we are not responsible for it. Use of the App Store and any Apple service is additionally governed by Apple's terms.
11. Availability and changes
We aim to keep the Service running but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features. If we discontinue the Service entirely, we will give account holders reasonable advance notice and an opportunity to download stored content.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be error-free, that processing will produce any particular result, or that any specific photograph will merge successfully.
13. Limitation of liability
13.1 Cap on liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAME PERFECT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL FEES YOU PAID US IN THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13.2 Excluded damages
WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, OR LOST GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
13.3 Content loss
You acknowledge that photography is time-sensitive and that a listing may carry deadlines outside our control — including multiple listing service submission deadlines, closing dates, and client commitments. We are not liable for any loss, corruption, failed processing, delayed delivery, or deletion of content, or for any missed listing deadline, lost sale, lost commission, cancelled engagement, or cost of reshooting a property, however caused.
You are solely responsible for maintaining your own backups of any photograph you cannot afford to lose, and for downloading finished work within the retention windows in Section 7.
13.4 Carve-out
Nothing in this Section limits liability for gross negligence, willful misconduct, fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
13.5 Basis of the bargain
The limitations in this Section are an essential basis of the agreement between us and are reflected in the price of the Service.
14. Indemnification
You will defend, indemnify, and hold harmless Frame Perfect LLC and its officers, members, and agents from any third-party claim, demand, loss, or expense (including reasonable legal fees) arising from: your content; your use of the Service; your breach of these Terms; your violation of any law; or your infringement of any third party's rights, including property, privacy, or publicity rights.
Procedure. We will notify you promptly of any claim, give you sole control of the defense and settlement (except that you may not settle in a way that admits fault on our behalf or imposes any obligation on us without our written consent), and provide reasonable cooperation at your expense. We may participate with our own counsel at our own cost.
15. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your account for breach of these Terms, non-payment, or where required by law.
On termination, your right to use the Service ends immediately and your stored content may be deleted. Sections 4, 5, 6, 12, 13, 14, 16, and 17 survive termination.
16. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. You and Frame Perfect agree to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas, and each waives any objection to venue there.
Before filing any claim, you agree to contact us at support@frameperfect.co and attempt in good faith to resolve the dispute informally for at least 30 days.
17. General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between us regarding the Service.
Severability. If any provision is held unenforceable, the rest remains in effect.
No waiver. Failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Changes. We may update these Terms. We will revise the date above and, for material changes, notify account holders by email before they take effect. Continuing to use the Service after that means you accept the revised Terms.
Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control.
